These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and FitnessVTC ("Company", "we", "us", "our"). By accessing our website, browsing products, adding items to cart, or completing a purchase, you agree to be bound by these Terms. If you do not agree, do not use our services.
2. Products and Pricing
- All prices are displayed in US Dollars (USD) unless otherwise specified
- Prices are subject to change without notice prior to order confirmation
- We reserve the right to cancel orders due to pricing errors
- Product images are for illustrative purposes; actual products may vary slightly
- We do not guarantee availability of any specific product
3. Order Process and Confirmation
An order is confirmed only after successful payment processing. Upon confirmation, you will receive an email receipt. Orders cannot be modified or cancelled after payment is processed. By placing an order, you represent that all information provided is accurate and complete.
4. Payment
Payments are processed securely through Stripe, Inc. We accept major credit cards (Visa, Mastercard, American Express, Discover) and other payment methods available through Stripe. By providing payment information, you authorize us to charge the full order amount.
All transactions are protected by SSL encryption and PCI DSS compliance. We do not store credit card numbers on our servers.
5. Stored Payment Methods, Auto-Recharge & Recurring Charges
CONSENT TO STORED PAYMENT & AUTOMATIC CHARGES:
- By completing a purchase, you authorize us to securely store your payment method (credit/debit card) via our payment processor, Stripe, Inc., for future transactions.
- You expressly consent to the following automatic charges on your stored payment method:
- Order balance adjustments - if a price correction, shipping surcharge, or tax adjustment applies to your order after initial payment
- Subscription renewals - if you enroll in any membership, subscription box, or recurring delivery program
- Replacement charges - if an item is replaced with a higher-value equivalent at your request
- Re-order / auto-recharge - if you opt into automatic re-ordering of consumable products (e.g., camp fuel, nutrition, water filters), we will charge your stored card at the interval you selected
- Failed payment recovery - if an initial charge fails or is reversed, we may re-attempt the charge up to 3 times within 30 days
- All automatic charges will be for amounts you have previously agreed to or for the current listed price of auto-reorder items
- You will receive an email notification at least 3 days before any automatic charge is processed (except failed payment retries)
- You may cancel auto-recharge or remove your stored payment method at any time by contacting support@fitnessvtc.com or through your account settings
- Stripe securely stores your card details. We never see or store your full card number. All stored payment data is encrypted and PCI DSS Level 1 compliant
- By checking the Terms of Service checkbox at checkout, you provide explicit written consent for the storage of your payment method and all automatic charges described in this section
6. Delivery Policy - 31-Day Window
PLEASE READ CAREFULLY BEFORE PURCHASING:
- Standard delivery takes up to 31 calendar days from the date of order confirmation
- Delivery times may vary based on your location, product availability, and carrier capacity
- The 31-day delivery window is a maximum estimate; most orders arrive sooner
- Tracking information will be provided via email once your order ships
- International orders may be subject to customs delays beyond our control
- We are not responsible for delays caused by incorrect shipping addresses provided by the customer
- By completing your purchase, you explicitly agree to the 31-day delivery window and waive any dispute claim based solely on delivery time within this window
7. Refund and Return Policy - ALL SALES FINAL
IMPORTANT NOTICE:
- ALL SALES ARE FINAL. We do not accept returns or issue refunds once an order has been shipped.
- Refunds are only issued in the following circumstances:
- Item was never shipped and tracking cannot be provided within 31 days
- Item arrived significantly damaged (photographic evidence required within 48 hours of delivery)
- Wrong item was shipped (must be reported within 48 hours of delivery)
- Refund requests must be submitted to support@fitnessvtc.com within 48 hours of delivery
- Buyer's remorse, incorrect size selection, or change of mind are NOT valid reasons for refunds
- Approved refunds will be processed within 10 business days to the original payment method
8. Chargeback and Dispute Policy
We take chargebacks very seriously. By purchasing from our store, you agree to the following:
- Before initiating any chargeback or payment dispute, you agree to contact us directly at support@fitnessvtc.com to resolve the issue
- Initiating a chargeback without first contacting us constitutes a breach of these Terms
- Chargebacks filed for items that were delivered per our stated 31-day policy are considered fraudulent and will be disputed with full documentation
- We reserve the right to refuse future orders from customers who have filed fraudulent chargebacks
- We will submit all available evidence to the card issuer to dispute fraudulent chargebacks, including order confirmation, shipping tracking, and IP/device records
9. Intellectual Property
All content on this website, including text, images, logos, and product descriptions, is the property of their respective owners. Product images and descriptions are provided for informational purposes. Unauthorized use, reproduction, or distribution of any content is prohibited.
10. Limitation of Liability
To the maximum extent permitted by law, FitnessVTC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or products. Our total liability shall not exceed the amount paid for the specific order giving rise to the claim.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of King County, Washington.
